What are the tax obligations for foreign rental income received by a French resident?

 

  • Reporting on form 2047: All foreign-source rental income must be reported on schedule 2047, section I "Revenus fonciers de source étrangère" (foreign-source rental income).
  • Transfer to the main return: The net taxable amount is then transferred to return 2042 (box 4BE) under the micro-foncier regime, or via form 2044 under the actual-expenses regime.
  • Subject to French social levies: This income is subject to the 17.2% social levies, even if it has already been taxed locally.
  • Tax credit on line 8TK: A credit is granted to avoid double taxation; it is offset up to the amount of the theoretical French tax.

How do you complete form 2047 step by step for an apartment rented out in Portugal?

 

  1. Section I – foreign rental income: Enter the gross rents received during the year in euros, at the ECB rate on the date of receipt.
  2. "Impôt payé à l'étranger" (tax paid abroad) column: Enter the amount withheld at source by the Portuguese tax authorities.
  3. Transfer to return 2044 or 2042: The net result must be transferred to return 2044 (under the actual-expenses regime) or to form 2042 (under the micro-foncier regime).
  4. Enter the tax credit on line 8TK: the amount to be entered is that of the rental income concerned (not that of the tax); the credit generally corresponds to the theoretical French tax on this income.
  5. Foreign supporting documents to keep: Attach the Portuguese tax receipts translated into French, to be kept for at least 6 years in case of an audit.

How can double taxation be avoided thanks to the tax credit on line 8TK and tax treaties?

  • Bilateral tax treaties to consult: These treaties set the maximum withholding rate in the source country.
  • Tax credit equal to French tax: If the foreign withholding is lower than the treaty rate, France grants a credit equivalent to the French tax on the income reported.
  • Mandatory supporting documents: The foreign withholding notice must be attached or kept, in particular for line 8TK of the return.

FAQ

Why does France tax me when I have already paid local tax on my foreign rental income?

As a French tax resident, you are taxable on your worldwide income, including income from a property rented out abroad. Even if the country of origin has already levied tax on your rental income, France also claims taxation.

However, to avoid double taxation, an equivalent tax credit is granted in France (line 8TK), provided that you complete form 2047 correctly and keep the supporting documents for the foreign withholding.

How do you complete form 2047 online for rental income received in the United Kingdom?

In the online version of the return, go to schedule 2047 and select the section "Revenus fonciers de source étrangère" (foreign-source rental income). Enter the gross amount of rent received, converted at the ECB rate, then indicate the tax withheld locally if applicable. Transfer the net result to return 2044 (if you are under the actual-expenses regime) or to form 2042 (micro-foncier).

Finally, don't forget to enter the tax credit on line 8TK. Keep the UK tax assessments for at least 6 years.

What should I do if I forgot to report foreign rental income for the last three years?

You must file amended returns as soon as possible for the years concerned, including schedules 2047 and 2044 if applicable. A spontaneous regularization before any audit limits the penalties, which can reach 40 to 80% in the event of fraudulent intent. It is also important to reconstruct any missing supporting documents (receipts, proof of payments).

Nous avons eu la mauvaise surprise de recevoir une "proposition de rectification" (contrôle fiscal) en fin d'année. Après avoir essayé de discuter avec le contrôleur j'ai vite compris qu'il était indispensable de se faire accompagner par un avocat car il n'est malheureusement pas possible d'échanger de manière constructive en cas de contrôle. L'erreur était flagrante et Me Uzan a réussi à donner les bons arguments. Résultats : quasiment tout a été annulé.
